General Terms and Conditions of Sale

1. Preamble

These General Terms and Conditions of Sale (hereinafter “GTC”) apply to all bookings made via the Que Faire Sénégal platform, operated by Welocal, a company registered under number SIREN 898 331 723 00038, with its registered office at 25 Parc d’Activité de Jabrun, 97122 Baie-Mahault, Guadeloupe, and with the following contact address: reservation@que-faire-senegal.com.

The Que Faire Sénégal platform’s mission is to list, promote, and facilitate the booking of tourist, cultural, and leisure activities in Senegal for residents and visiting tourists, in partnership with local providers.

Welocal acts as a technical and commercial intermediary and not as the direct service provider. The service contract is concluded between the client and the provider under the conditions specified below.

2. Purpose

These GTC define the terms under which users of the platform book and pay for activities listed on the site www.que-faire-senegal.com.
They set out the respective rights and obligations of Welocal, clients, and partner providers.

3. Scope

These GTC apply to all bookings of activities offered via the Que Faire Sénégal platform, regardless of the user’s country of origin.
Any booking implies full and unconditional acceptance of these GTC.

4. Booking Process

4.1. Registration and User Account

Booking may require creating a user account. The user agrees to provide accurate, up-to-date, and complete information and not to impersonate a third party.

4.2. Selection and Description of Activities

Each activity listed on the platform is described according to the information provided by the provider: content, duration, location, included equipment, required skill level, etc.
Welocal cannot be held responsible for minor differences between the description and the actual experience when these arise from local, technical, or weather-related conditions.

4.3. Booking and Confirmation

A booking becomes firm after:

  • selection of the activity,
  • payment of the corresponding price via one of the available payment methods,
  • receipt of a WhatsApp and/or email confirmation issued by Welocal.

4.4. Payment Methods

Payments are accepted by credit card, Wave, and Orange Money.
Amounts can be displayed and paid in CFA francs (FCFA), euros (€), or US dollars (USD) depending on the user’s preference.
Full payment is required at the time of booking.

5. Prices and Payment

Prices listed on the platform are expressed in FCFA, EUR, or USD, all taxes included (TTC).
They are set jointly with partner providers to ensure fair and accessible rates for residents and tourists.

Welocal reserves the right to change prices at any time, without retroactive effect on already confirmed bookings.

6. Cancellation, Modification, and Refund

6.1. Cancellation by the Client

Any cancellation must be communicated in writing to: reservation@que-faire-senegal.com or via WhatsApp at the number indicated in the confirmation.
Refund conditions are as follows:

  • Full refund if the cancellation occurs at least 48 hours before the scheduled date;
  • 50% refund if the cancellation occurs between 24 and 48 hours before the scheduled date;
  • No refund if the cancellation occurs less than 24 hours before the activity or in case of no-show.

6.2. Cancellation or Modification by the Provider

The provider may need to cancel or modify an activity for safety reasons, adverse weather conditions, or force majeure.
The client will be informed as soon as possible and may:

  • Benefit from rescheduling or an equivalent activity, or
  • Receive a full refund.

6.3. Cancellation by Welocal

Welocal may cancel a booking for exceptional reasons (availability error, technical issue, provider cancellation). The client will be fully refunded.

7. Responsibilities

7.1. Role of the Platform

Welocal acts as an intermediary platform connecting clients and providers.
As such, Welocal does not directly provide the activities and cannot be held responsible for:

  • the quality, compliance, or safety of the services provided;
  • any damage, loss, or accidents occurring during the activity;
  • information or commitments made by the providers.

7.2. Responsibility of the Provider

The provider is solely responsible for the compliance, safety, and proper conduct of their activity.
They guarantee that they are duly authorized and insured to operate in Senegal.

7.3. Responsibility of the Client

The client agrees to follow the provider’s instructions, arrive on time, behave respectfully, and inform the provider of any physical, medical, or personal constraints that may affect participation.

8. Force Majeure

No party shall be held liable for failure to fulfill its obligations if caused by a force majeure event (natural disaster, strike, conflict, epidemic, network outage, extreme weather, etc.).

9. Insurance

Each provider agrees to have professional liability insurance appropriate for their activity.
Clients are encouraged, if they wish, to take out additional personal insurance (travel, health, accident).

10. Personal Data

Welocal collects and processes users’ personal data in accordance with applicable law and its Privacy Policy, available on the website.
These data are used exclusively for booking management, customer relations, and service improvement.

11. Intellectual Property

All site content (texts, photographs, videos, illustrations, logo, graphic charter) is protected by French and international intellectual property laws.
Any total or partial reproduction without prior written authorization is prohibited.

12. Applicable Law and Jurisdiction

These GTC are governed by French law.
All disputes arising from the application of this agreement shall be submitted to the Commercial Court of Marseille.

13. Acceptance of Terms

Confirming a booking on the site constitutes full and unconditional acceptance of these General Terms and Conditions of Sale.
The user acknowledges having read and understood the GTC before placing any order.
